Collaborative is a new concept to the Irish Legal System. It is a process whereby married couples who are separating or divorcing can work together in a structured format with specially trained solicitors, to try and reach agreement on the issues between, without the need for expensive and time consuming court applications. It is designed to be far more user friendly than general litigation and it is hoped that by engaging in the process of Collaborative Law couples can go through the separation process and come out of it and still be able to talk to each other rather than being unable to sit in the same room as can be the case when a family law case goes to court. The new process will not suit all parties but it is a process that has gained popularity in the last two years and seems to be here to stay.
